MEMORANDUM OF UNDERSTANDING <br /> REGARDING <br /> MANAGEMENT AND MAINTENANCE <br /> BETWEEN <br /> ELK RIVER HOUSING AND REDEVELOPMENT AUTHORITY <br /> AND <br /> THE CITY OF ELK RIVER,MINNESOTA <br /> This MEMORANDUM OF UNDERSTANDING,hereinafter referred to as"MOU",is hereby <br /> made and entered into on this 7th day of May,2012,by and between the City of Elk River, <br /> Minnesota,hereinafter referred to as the"City"and the Housing and Redevelopment Authority <br /> in and for the City of Elk River,hereinafter referred to as the"HRA". <br /> 1.0 Purpose <br /> The purpose of this MOU is to address the management and maintenance of the HRA owned <br /> Main Street Parking Plaza,hereinafter referred to as the"Lot", located at 716 and 720 Main <br /> Street within the City of Elk River,Minnesota. <br /> 2.0 Review and processing of special event permits <br /> The City will review,process and act on all applications for special event permits for use of the <br /> Lot in the same manner as applications for the use of City owned property. <br /> 3:0 Management and Maintenance of Lot <br /> The City will manage and maintain the Lot in the same manner as City owned parking lots and <br /> landscaping. The HRA will reimburse the City for all material costs and labor associated with <br /> management and maintenance of the Lot in an amount the HRA and City will agree to annually. <br /> In addition,if the City determines that the Lot requires sealcoating,the cost of seal coating will <br /> be billed to the HRA. <br /> The following maintenance/labor will be the responsibility of the Parks and Recreation <br /> Department: irrigation,repairs and water consumption. The following maintenance/labor will be <br /> the responsibility of the Streets Department: snow removal,paint striping,sweeping and <br /> cracksealing. <br /> 4.0 Termination of MOU <br /> This MOU may be cancelled or terminated without cause by either party by giving(30)calendar <br /> days advance written notice to the other party.Such notification shall state the effective date of <br /> termination or cancellation. Any and all amendments must be made in writing and must be <br /> agreed to and executed by the parties before becoming effective. <br /> IN WITNESS WHEREOF,each of the parties has caused this MOU to be executed by their duly <br /> authorized representatives: <br /> 1 <br />
