Planning Commission/CU 04-28 <br /> October 26,2004 <br /> Page 2 <br /> Overview <br /> In order to meet the ever growing needs of their congregation the applicant is beginning the <br /> design process for a building expansion. They have a shortage of office space in their <br /> existing facility. They are requesting an Interim Use Permit to place a portable office on the <br /> south side of their existing building. <br /> Analysis <br /> The proposed location of the portable office is on the south side of the existing building and <br /> will be on site until the summer of 2006, at which time the portable structure would be <br /> removed. The location of the portable office would not affect either traffic circulation or <br /> parking. <br /> The location will not be visible from surrounding residential structures. <br /> Criteria for Issuance of an Interim Use Permit <br /> In determining whether to authorize an interim use, the planning commission and city <br /> council shall consider the following criteria: <br /> 1) The period of time for which the interim use permit is to be granted will terminate <br /> before any adverse impacts are felt upon adjacent properties. <br /> 2) There is adequate assurance that the property will be left in suitable condition after <br /> the use is terminated. <br /> 3) The use is similar to uses defined in the zoning district in which the property is <br /> located. <br /> 4) The date or event that will terminate the use can be identified with certainty. <br /> 5) Authorizing the use will not impose additional costs on the public if it is necessary <br /> for the public to take the property in the future. <br /> 6) The applicant and user agree to all conditions that the city council deems appropriate <br /> for authorization of the interim use. <br /> 7) The applicant provides assurances deemed adequate by the city council that the use <br /> will terminate as provided in the interim use permit. The city council may require the <br /> applicant to deposit a cash amount with the city, or provide some other form of <br /> security, to ensure compliance with this criteria. <br /> The city council must determine that the authorization of the interim use will not result in <br /> adverse effects on the public health, safety, or welfare. <br /> S:\PLANNING\Case Files\2004\CU 04-28 River of Life\CU 04-28_PC.DOC <br />
