During that process, a portion of the subdivision was <br /> indicated as "park". It is shown on the plat exhibit as the area south of Lot 10,Block 5, and north of <br /> Lake Orono. It is unclear as to the ownership of this parcel but staff is working with the county to <br /> identify the owner. This section was platted when that area was in the township. Since then,this area has <br /> become part of the City of Elk River. <br /> Two streets were indicated on the plat as Western Avenue and Park Avenue giving access to the "park" <br /> and other properties. <br /> The "Park Lane" street right-of-way provides no benefit to the City or Elk River Municipal Utilities. <br /> Staff has no concern with vacating a portion of this street. <br /> The "Western Avenue" street right-of-way may provide access to what might be parkland. Staff has <br /> concern with vacating this street,as it is unclear what the status of the property shown as "park"is an <br /> how it may be accessed. Further,private improvements have been made in the area that suggest <br /> ownership has previously transferred. <br /> Parks and Recreation Commission <br /> Based on the limited information presented,the Parks and Recreation Commission recommended the <br /> street be vacated as shown on Exhibit A. <br /> Recommendation <br /> Because of the lack of ownership information and actual property line placements, staff recommends <br /> postponing action until further information can be obtained.
