The <br />Responsible Governmental Unit (RGU) makes the determination whether a project has <br />the potential for significant environmental effects and an EIS is needed to further study <br />the issues. The Elk River City Council is the RGU for the Trott Brook Farms Project. <br /> <br />The sources of information from which the Council will make their determination <br />regarding the need for an EIS are the EAW itself, comments received on the EAW, and <br />the responses to the comments received. The following information is attached to this <br />memo: <br /> <br />· The Trott Brook EAW <br /> <br />Comment letter from Thomas Balcom of the Minnesota Department of Natural <br />Resources, dated July 28, 1998 (the DNR basically said they did not feel an EIS is <br />needed for this project and no response to their comments seems necessary). <br /> <br />· Comment letter from Paul Hoffofthe Minnesota Pollution Control Agency, dated <br /> July 31, 1998. <br /> <br />· Staff's response to Mr. Hoff's letter, dated August 5, 1998. <br /> <br />· A resolution making a negative declaration on the need for an EIS for this project. <br /> <br />13065 Orono Parkway · P.O.
