Section, Lot, Block, Subdivision, City, County) <br /> <br />(For seasonal/annual exemption attach proposed general location information, i.e. maps, aerial photos) <br /> <br />The wetland activity at the above site is exempted from or in compliance with the Wetland Conservation <br />Act (WCA) for the following reason: [Please Circle (A), (B), (C), (D), OR (E)] <br /> <br />This exemption certification expires <br /> <br />(A) A Wetland Does Not Exist; OR <br /> <br />NIA <br />(Dale) <br /> <br />Exemption #MN Rules Part 8420.0122, Subp, 5 (Incidental wetlands) (per MN Rule Chapt. 8420) <br /> <br />Description of Exemption .- <br /> <br />Subp. 5. states that: <br />"Wetlands; may be drained or filled if the landowner can show that the wetland was created <br />solely by actions, the purpose of which was not to create the wetland." <br /> <br />(c) <br /> <br />The exempt wetland areas Include: (1} 4,126 square feet of an excavated ditch at the north end of <br />Basin 10, and (2) Basin 18, which is a 110-square-foot excavated open water wetland. At a <br />Technical Evaluation Panel (TEP) meeting convened at the City of Elk River on May 21, 1998, the <br />TEP determined that both areas were unintentionally created and are exempt. <br /> <br />Wetland Loss Has Been Avoided; OR <br /> <br />(D) Wetland Has Been Replaced As Per Approved Plan (attached); OR <br /> <br /> (E) No Loss Determination (attach plans). <br /> The informat~ provided for this determination is truthful and accurate to the best of my knowledge, <br /> <br />~,'Appll'6a~t ~ign"att~re ' (Dated) <br /> <br />LGU Official Signature <br /> <br />(Dated) <br /> <br />*THIS CERTIFICATION ONLY APPLIES TO THE WCA OF 1991.
