ity of <br /> <br />River <br /> <br />Item #4.9. <br /> <br />MEMORANDUM <br /> <br />TO: <br /> <br />FROM: <br /> <br />DATE: <br /> <br />Mayor & City Counc~l~ <br />Pat Klaers, City Ad~l~i~or <br />August 17, 1998 <br /> <br />SUBJECT: School Street Easement <br /> <br />School Superintendent Dr. Flannery has advised me that at the August 11 <br />School Board meeting, action was taken on the city's request to obtain an <br />easement for the expansion of School Street. The action taken was to grant <br />the city the easement conditioned upon assessments being levied on an equal <br />basis to all taxpayers on both sides of the street, and, if the city financially <br />participates in the project, then the participation must benefit all parties <br />equally. I have not seen the draft minutes to have the exact wording of the <br />motion, but I believe that the above sentence reflect the general content of <br />the motion. (i.e. The District Board wants the south property owners to pay <br />what the school is paying.) <br /> <br />The city cannot accept the easement under these conditions. It is <br />recommended that the City Council formally reject the easement with these <br />conditions. This Council action will then be relayed to Dr. Flannery and he <br />will present this information to the School Board at its August 25 meeting. <br /> <br />If different action is not taken by the School Board on August 25 in order to <br />provide the city with the necessary easement, then the opportunity to do the <br />construction project on the west side of Proctor Avenue will be lost for 1998. <br />Additionally, ff the city does not obtain this easement without conditions in <br />the not too distant future, then staff will be recommending that the city begin <br />the eminent domain process to obtain the easement or right-of-way for the <br />1999 improvement project. Action on beginning the eminent domain process <br />is not requested or desired at this time as I think it is fair to see how the <br />School Board will respond to our action at their August 25 meeting. <br /> <br />Action Requested <br /> <br />Motion rejecting the School Street easement as conditioned by the School <br />District. <br /> <br />13065 Orono Parkway · P.O.
