b. The employee is requested by a public body or office to participate in an <br /> investigation, hearing, inquiry; or <br /> c. The employee refuses the Utilities' order to perform an action that the <br /> employee has an objective basis in fact to believe violates any State or <br /> Federal law or rule regulation adopted pursuant to law and the employee <br /> informs the Utilities that the order is being refused for that reason. <br /> The Utilities will make reasonable efforts to preserve as confidential the identity of an <br /> employee making a report under this policy to the extent feasible and consistent with <br /> applicable law. Any Utilities manager who receives a report under this policy is required <br /> to communicate the matter to the Human Resources Representative immediately. <br /> Employees shall not make any statements or disclosures pursuant to this section knowing <br /> that they are false or that they are in reckless disregard of the truth. This section does not <br /> permit disclosures that would violate federal or state law or diminish or impair the right <br /> of any person to the continued protection of confidentiality or communications provided <br /> by common law. <br /> 10. WEAPONS PROHIBITED <br /> Elk River Municipal Utilities prohibits all employees from carrying or possessing <br /> firearms or other weapons while acting in the course and scope of their employment for <br /> the Utilities. Carrying or possessing firearms or weapons in Utilities vehicles is also <br /> prohibited. <br /> This policy extends to any situation in which employees are acting in the course and <br /> scope of their employment including while utilizing personal vehicles or attending work- <br /> related training. However, it is not a violation of this policy to lawfully carry a firearm in <br /> a personal vehicle that is lawfully encased and secured. Employees may be disciplined <br /> for violations of this policy up to and including termination of employment. <br /> A narrow exception is made to this policy, which is applicable only in connection with <br /> attendance at the Minnesota Municipal Utilities Underground School ("MMUA <br /> Underground School") or the Minnesota Municipal Utilities Overhead School ("MMUA <br /> Overhead School"). Both of these events are held at the MMUA Training Center in <br /> Marshall, MN. An employee is not prohibited from carrying or possessing a firearm or <br /> other appropriate weapon in a situation where, in connection with his or her Utilities <br /> employment, the employee is using a Utilities vehicle while attending MMUA <br /> Underground School or MMUA Overhead School --- if and only if the employee's <br /> participation in the MMUA Underground School or MMUA Overhead School includes a <br /> hunting or target-shooting activity, and provided that the employee is otherwise lawfully <br /> permitted to carry and possess a firearm.
