As a Conditional Use Permit is not a Building Permit, the applicant shall apply for all
required permits.
2. The duration of each display shall not be less than 8 seconds.
3. The transition time between messages shall be at least 2 seconds.
4. The sign shall be equipped with a mechanism that automatically adjusts the brightness
in response to ambient conditions. These signs must also be equipped with a means to
immediately turn off the display or lighting if it malfunctions.
BACKGROUND /DISCUSSION
In 2004, the subject property was created as part of the Carson Business Park plat. The subject property
was platted as a replacement location for the existing billboard that was located at the intersection of
Main Street and Highway 169 at that time. Advertising Signs (billboards) are considered a principle use,
and therefore are only permissible if placed on their own lot.
A sign permit was issued for the property in 2005 as the lot was created for the billboard. At the time it
was not realized that the whole lot is covered by a drainage and utility easement. Our city code does not
allow structures in drainage and utility easements. The billboard is a legal non - conforming structure and
the replacement of the faces /copy is allowed, based on instruction from the City Attorney.
Zoning
The subject property is zoned Highway Commercial (C3) and advertising signs (billboards) are regulated
by the Conditional Use Permit process in this district.
Advertising Sign
The proposed sign is the same size (36' -0" x 10' -6 ") as the existing billboard. They are requesting the
same 25' -0" height.
P 0 W [ R E 0 1
N: \Departments \Community Development \Planning \Case Files \CUP \CU 13 -03 Franklin Outdoor \CU 13- 03_PC.doci I'N"ATURE]
