Finding: The amount of signage requested by the applicant exceeds a <br />reasonable amount of signage for the accessory building. <br />(4) The plight of the petitioner is due to circumstances unique to the property not a <br />consequence of the petition's own action or inaction; and <br />Finding: The petitioner does not make an argument that the lot is unique. <br />(5) The variance, if granted, will not alter the essential character of the locality. <br />Finding: In the Highway Business District, character is established by wide <br />setbacks, expansive parking lots, and signage. Significant departures from <br />the ordinances that define these characteristics cannot help but alter the <br />locality. The erosion of minimum standards over time alter the character of <br />an area. <br />(d) Economic considerations alone do not constitute practical difficulties. Practical <br />difficulties include, but are not limited to, inadequate access to direct sunlight for solar <br />energy systems. <br />Finding: The applicant desires not to `waste' the investment of existing "Car <br />Wash" signage. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Elk <br />River, based on the findings of fact set forth above, hereby denies the Application for a <br />Variance to allow additional signage. <br />Passed and adopted this 22 °d day of January 2013. <br />ATTEST: <br />Tina Allard, City Clerk <br />John J.
