As a Conditional Use Permit is not a Building Permit, the applicant shall <br /> apply for all required permits,including but not limited to water connection, <br /> building, and grading. <br /> 2. The development shall meet all applicable fire codes. <br /> 3. A National Pollutant Discharge Elimination System (NPDES) permit is <br /> required prior to final approval of construction drawings. <br /> 4. No change to the flood plain is permitted. <br /> In addition to these 4 conditions, staff suggests the two following conditions: <br /> 5. No parking shall be permitted within the County Road 12 Right-of-Way <br /> without County approval. <br /> 6. This Conditional Use Permit shall terminate with the termination of the <br /> Conditional Use Permit for Spectrum High School at 17791 Industrial Circle. <br /> BACKGROUND/DISCUSSION <br /> Spectrum Charter school seeks Conditional Use Permit approval to improve the approximately 39 acres <br /> at 10129 181st Avenue into an athletic complex featuring a softball,a baseball,and two multi-use fields. <br /> One of the multiple-use fields will be lit in phase two of the improvements. Other improvements include <br /> grading,landscaping,renovation of the storm shelter into restrooms, shelter,and storage,and parking lot <br /> improvements,including lighting. <br /> The issues in summary: <br /> Floodplain: Much of the property is impacted by the recently amended flood regulations. The applicant <br /> has developed a plan acceptable to the Environmental Administrator and the Department of Natural <br /> Resources as having no measurable impact to the flood levels upstream. <br /> Lighting: The parking lot lights comply with City Code. City Code does not expressly regulate field <br /> lighting.
