4. Use of Easement. The owners of Parcel B shall be free to utilize the <br /> Amended Driveway Easement for residential ingress and egress purposes, including but <br /> not limited to, the use of any type of non-commercial motorized or non-motorized vehicle <br /> and/or recreational equipment. Parking, storage or placement of vehicles, structures or <br /> other items is not permitted in the Amended Driveway Easement. Commercial vehicle <br /> use of the Amended Driveway Easement, except for deliveries to Parcel B, is not <br /> permitted. <br /> 5. Benefited Parcel. The Amended Driveway Easement is for the benefit of <br /> and appurtenant to Parcel B. <br /> 6. Term. The Amended Driveway Easement shall be perpetual. <br /> 7. Covenants Running With Land. The Amended Driveway Easement <br /> hereby granted, the restrictions hereby imposed, and the agreements herein contained <br /> shall be easements, restrictions, and covenants running with the land and shall inure to <br /> the benefit of, and be binding upon, the parties hereto and their heirs, successors and <br /> assigns. <br /> 8. Not a Public Dedication. Nothing contained in this instrument will be <br /> deemed to be a gift or dedication of any portion of the easement to the general public or <br /> for the general public or for any public purpose whatsoever, it being the intention that this <br /> instrument will be strictly limited to and for the purposes expressed herein. <br /> 9. Indemnity. The owners of Parcel B hereby agree to indemnify and hold <br /> harmless the owner of Parcel A against any and all claims and any damage or loss due to <br /> the use of the Amended Driveway Easement by the owners of Parcel B, their guests and <br /> invitees. <br /> 3 <br /> GP:3221224 v4 <br />
