He stated that the applicant would like to place a sign closer to <br />the intersection of Highway 10 and 173~ Avenue. <br />Mr. Leeseberg stated that staff is recommending denial of the variance as the applicant does <br />not meet the five findings for granting a variance. <br /> <br />Mayor Klinzing opened the public hearing. <br /> <br />Chad Lundquist, 19509 Boston Street-Stated that he did not receive his notification of the <br />Planning Commission hearing regarding this issue; therefore he was unable to attend that <br />meeting. He stated that many other businesses in Elk River have more than one sign. He <br />stated that he is confused as to why the city recommends denial of his request. Mr. <br />Lundquist stated that his family owns the property that Riverview Sports is located on and <br />he owns the property on which he would like to install the new sign. <br /> <br />Ms. McPherson stated that the issue before the Council is that the applicant is requesting an <br />off-premise sign (a billboard). <br /> <br />Mayor Klinzing closed the public hearing. <br /> <br />Councilmember Tveite questioned if a condition could be added stating that as long as <br />ownership in the property remains in the family then the sign could remain. <br /> <br />Mr. Beck stated that conditions could be added to a variance but he would like to see this <br />item tabled and some findings established for approval. <br /> <br />Councilmember Kuester stated that she believes some findings have been met for the <br />variance request. She stated that access and visibility to the business is limited due to <br />reconstruction in the area and a directional sign is needed for area businesses. <br /> <br />COUNCILMEMBER MOTIN MOVED TO TABLE THIS ITEM UNTIL <br />NOVEMBER 17, 2003. MAYOR KLINZING SECONDED THE MOTION. THE <br />MOTION CARRIED <br />5-0. <br /> <br />Request by Aggregate Industries for an Amendment to a Conditional Use Permit for <br /> <br />Mineral Extraction, Public Hearing-Case No. CU 03-29 <br /> <br />Building and Zoning Administrator Steve Rohlf submitted the staff report. Mr. Rohlf stated <br />that the applicant is requesting to expand its existing gravel mine to include an additional 80 <br />acres. He stated that the property is zoned Mineral Excavation Overlay Zoning District and <br />it was included in the city's Environmental Impact Study on mineral excavation. Mr. Rohlf <br />stated that the existing mining operation had no issues for the first two years but in the third <br />year there were noise complaints from surrounding neighbors. He stated there was also a <br />concern with ground water protection. Mr. Rohlf stated that staff has held neighborhood <br />meetings and the issues appear to have been resolved. He stated that Aggregate Industries is <br />opposed to Condition number 10 regarding traffic. <br /> <br />Mayor Klinzing opened the public hearing. <br /> <br /> <br />
