Ms. Sitts stated that • <br /> the recitals would continue to be held at the Elk River High School. <br /> There being no one to speak to this issue,Chair Anderson closed the public hearing. <br /> MOTION BY COMMISSIONER JOHNSON AND SECONDED BY <br /> COMMISSIONER WESTBERG TO RECOMMEND APPROVAL OF THE <br /> REQUEST BY PAMELA SITTS FOR A CONDITIONAL USE PERMIT TO <br /> AMEND BARRINGTON SQUARE PUD TO ALLOW PHYSICAL <br /> RECREATION AND TRAINING USES. MOTION CARRIED 4-0. <br /> MOTION BY COMMISSIONER WESTBERG AND SECONDED BY <br /> COMMISSIONER JOHNSON TO RECOMMEND APPROVAL OF THE <br /> REQUEST BY PAMELA SITTS FOR A CONDITIONAL USE PERMIT TO <br /> ALLOW PHYSICAL RECREATION AND TRAINING USE(DANCE <br /> STUDIO — PS DANCE),AT 251 8"h STREET NW. MOTION CARRIED 4-0. <br /> 4.3 Request by City of Elk River to Rezone certain portions of the Nature's Edge Business <br /> Center to Business Park(BP) and Highway Business (HB).Public Hearing—Case No. ZC <br /> 12-03 <br /> Jeremy Barnhart presented the staff report. He explained the current land use and zoning of <br /> the property to be rezoned. He noted that a portion of the property cannot be zoned <br /> residential,per an agreement with Cargill when the city acquired the property that there <br /> would be no residential development for a minimum of 10 years. Staff recommended <br /> approval of the rezonings,confirming that the zoning was consistent with the <br /> comprehensive plan and growth expectations for this area. <br /> Chair Anderson opened the public hearing. There were no comments from the public. <br /> Chair Anderson closed the public hearing. <br /> Commissioner Westberg asked if the zoning will be looked at again in 10 years when the <br /> agreement with Cargill expires,or when the Highway 10 interchange is built. Mr.Barnhart <br /> stated that as the area develops with other uses than residential,it will be less likely that the <br /> city would want to zone the northern portion of the property residential. He also stated that <br /> staff is not recommending a special temporary destination retail zoning at this time,since it <br /> is not known when the interchange will be built. He stated that the best the city can do at <br /> this time is to inform future property owners that their use may be under an interchange at <br /> some point in time. <br /> MOTION BY COMMISSIONER WESTBERG AND SECONDED BY <br /> COMMISSIONER JOHNSON TO RECOMMEND APPROVAL OF THE <br /> REQUEST BY THE CITY OF ELK RIVER FOR A REZONING OF CERTAIN <br /> PROPERTY LOCATED WITHIN NATURE'S EDGE BUSINESS CENTER TO <br /> BUSINESS PARK(BP)AND HIGHWAY COMMERCIAL(C-3). MOTION <br /> CARRIED 4-0. <br /> 4.4 Request by City of Elk River for Ordinance Amendment regarding Commercial Recreation <br /> 411 Uses.Public Hearing—Case No. OA 12-03 <br />
