City "f <br />EIE <br />liver <br />13065 Orono Parkway <br />Elk River, 1,4N 55330 <br />August 9, 2012 <br />Dear Asphalt Contractor: <br />Similar to many other communities throughout the state, the City of Ells River is seeking to adopt <br />an ordinance banning the sale and application of any coal tar -based sealer to any driveway, <br />parking lot, or other surface within the City of Elk River. This ordinance will be brought to the <br />City Council on August 13, 2012, and will take immediate effect once it is passed. <br />The use of sealers on asphalt surfaces is a common maintenance practice. However, scientific <br />studies on the use of pavement sealers have demonstrated a relationship between stormwater <br />runoff and certain health and environmental conditions, including the presence of Polycyclic <br />Aromatic Hydrocarbons (PAHs), a known carcinogen. <br />The purpose of this ordinance is to regulate the use of sealer products within the City of Ells <br />River, in order to protect, restore, and preserve the quality of its waters. Further, it is the purpose <br />of this ordinance to enhance compliance with the application prohibition through regulating sale <br />of certain products. <br />Enforcement will be taken on any person violating this ordinance.
