Charge an administrative penalty of $100 and/or be required to complete <br />tobacco related education classes, diversion programs, or community <br />services. The City can still seek misdemeanor prosecution for violations of <br />this ordinance. <br /> <br />7. Establishment of an administrative hearing panel and administrative <br />hearing process. <br /> <br />The Administrative Hearing Officer is a person authorized by the City to <br />conduct a hearing. The opportunity for an administrative hearing must be <br />afforded to alleged violators of this ordinance except for those violations <br />treated by prosecution). <br /> <br />ORDINANCE ADOPTION PROCESS: <br /> <br />State law requires that the city must give general notice of its intent to adopt <br />the tobacco ordinance by sending mailed notice at least 30 days before the <br />Council's hearing on the ordinance to each licensee or person required to hold <br />a license. All licensees have been notified of this hearing. The Mayor should <br />open the public hearing to allow public comment on the City's draft tobacco <br />ordinance. <br /> <br />This ordinance will take effect on July 1, following Council adoption and <br />publication of this ordinance. A copy of the ordinance and a letter indicating <br />compliance by July I will be mailed to all licensees. <br /> <br />It is the city's intent to try to meet the state law minimum standards, to work <br />with the retailers and to reduce access to reduce illegal youth access to <br />tobacco. <br /> <br />COUNCIL ACTION REQUESTED: <br /> <br />Council motion adopting the proposed tobacco ordinance. <br /> <br /> <br />
