ity of <br /> <br />River <br /> <br />Item 4.1. <br /> <br />MEMORANDUM <br /> <br />TO: <br /> <br />FROM: <br /> <br />DATE: <br /> <br />SUBJECT: <br /> <br />Mayor and City Council <br /> <br />Sandra Thackeray, City Clerk <br /> <br />June 1, 1998 <br /> <br />Public Hearing for Tobacco Ordinance <br /> <br />During the 1997 legislative session, the Minnesota legislature passed a state <br />law designed to reduce illegal youth access to tobacco products. Now, <br />communities must implement and enforce this law. To do so, the City must <br />amend its tobacco licensing ordinance to at least meet the state-wide <br />minimum standards. <br /> <br />On April 27, 1998, the Council reviewed a draft of the City of Elk River <br />Tobacco Ordinance. Following that meeting, the Council requested a few <br />revisions to the draft ordinance. These revisions have been made and are as <br />follows: <br /> <br />· Section 708.08(6) - This has been revised to ensure that property taxes <br /> are paid prior to a tobacco license being issued. <br />· Section 708.22(3) - This requires minors to pay a penalty of $100 for <br /> minors who are found in unlawful possession of tobacco, or unlawfully <br /> purchase or attempt to purchase tobacco or tobacco products. <br />· Section 708.24(1 & 2) - This revision indicates that the hearing officer is a <br /> person authorized by the City. <br /> <br />Listed below are some of the major issues that have been addressed in the <br />City's ordinance. <br /> <br />1. Licensing o£ all tobacco retail outlets. <br /> <br />· The City will license all tobacco retail outlets. The licensing fee for one <br /> year is $100.00. <br /> <br />2. Ban on self-service displays of single packs of cigarettes and smokeless <br />tobacco. <br /> <br />13065 Orono Parkway · P.O.
