This Agreement and the Declaration shall be binding upon and inure to the benefit of the Public Entity and DEED, and their respective successors and assigns. Provided, however, that neither the Public Entity nor DEED may assign any of its rights or obligations under this Agreement or the Declaration without the prior written consent of the other party. No change or modification of the terms or provisions of this Agreement or the Declaration shall be binding on either the Public Entity or DEED unless such change or modification is in writing and signed by an authorized official of the party against which such change or modification is to be imposed. Section 7.17 Waiver.
