Those that were opposed to the request cited the total number of dogs in the past, they are on the <br />downhill side of the subject property and see everything, and that the applicant should have to follow the <br />same rules as the rest of the city. <br />The applicant spoke to explain what a therapy dog is and the extensive training/time they require to <br />become one, typically about three years. He explained what the dogs do and how they have to be well <br />behaved and quiet because of the environments they go to. He indicated he has no desire to increase his <br />kennel size (number of dogs) and just wants to keep his dogs until they pass away. He will not be <br />breeding the dogs. The dogs are house dogs and do not care to be outside too much and only like. <br />weather that is 65-70 degrees. He stated if he sees that his neighbors have their dog out, he waits to bring <br />his outside. He is outside with the dogs at all times and carries a scooper with him to immediately clean <br />up after the dogs. <br />One commissioner asked what happens when five different dogs may be at the kennel. This was in <br />reference to the comment that CUP's run with the property and not the applicant. Several <br />commissioners agreed that the nature of therapy dogs is well behaved. One commissioner thought that <br />two extra dogs could be an issue given the small lots sizes and proximity to neighbors. A tenth condition <br />requiring the south fence to be opaque was discussed to address one of the concerns by those opposed to <br />the request. <br />PRIVATE KENNEL LICENSE <br />Tim Peterson has made application for a private kennel license in order to keep five dogs. The applicant <br />has submitted all the necessary application materials and has successfully completed a kennel inspection <br />by the Police Department. Kennels are inspected on a yearly basis prior to renewal of the license to <br />ensure that the applicant is meeting the requirements of the ordinance relating to private kennels. <br />A Conditional Use Pernut is required for this license because the property is less than five acres in the <br />R1a zoning district.
