Johnson for Conditional U se jerem Barnhart, Plannin Mana er <br />Permit to amend Elk River Retail PUD to allow Commercial REVIEWED BY <br />Recreational Uses, Case No. CU 12-01 <br />ACTION REQUESTED <br />Staff recommends that the Planning Commission recommend approval of the amendment to the Elk <br />River Retail Center Planned Unit Development (PUD) to allow commercial recreational uses. <br />BACKGROUND/DISCUSSION <br />The subject property is currently zoned PUD. The Elk River Retail Center PUD agreement was created <br />in 1.995 and commercial recreational uses are not allowed by the PUD agreement. The term/use of <br />commercial recreation is relatively new and has only been incorporated into our ordinance language for <br />approximately five years. The thought of including these uses was not even considered in 1995. <br />Some examples of commercial recreation uses are, but not limited to: dance studios, bowling alleys, <br />fitness center, gymnastic studios and karate studios. <br />Land Use <br />The subject property has an underlying land use of Highway Business which is the most intensive form of <br />commercial development in Elk River. Businesses in this category may be the largest both in terms of <br />size and traffic generation. Market orientation tends to be regional in nature. The uses range from <br />commercial areas that are occupied by professional trades to more intense commercial activities requiring <br />highway orientation for access and visibility.
