A variance is obtained from the Shore land regulations. <br />2. As a Conditional Use Permit is not a Building Permit, the applicant shall apply for all <br />require permits. <br />3. The development shall meet all applicable fire codes. <br />4. All signage must receive a permit prior to construction and installation. <br />5. A 12 foot easement for trail purposes shall be provided immediately south of the existing <br />curb line on the south side of the site. <br />Applicant Vanman Architects and Builders, on behalf of Elk River Lutheran <br />Church and the ELCA <br />Address 729 Main Street <br />60 Day Rule The City must take action by March 30, 2012 <br />OVERVIEW <br />The applicant is requesting Conditional Use Permit approval to operate an institutional use in the <br />Downtown District (DD) zoning district. <br />BACKGROUND/PRECEDENT <br />Churches are classified as an institutional use in the Elk River Zoning Code; institutional uses are a <br />conditional use in most Elk River Zoning districts, including the Downtown District. <br />Elk River Lutheran Church formed in 2010 and they moved into a temporary space in Northbound <br />Crossing late that year. They received an interim use permit for that location, which is to expire in <br />December 2015. <br />
