REQUEST FOR ACTION <br />TO ITEM NUMBER <br />Ma or and Ci Council 7.2 <br />AGENDA SECTION MEETING DATE PREPARED BY <br />Public Hearin s Febru 21, 2012 erem Barnhart, Plannin Mana er <br />ITEM DESCRIPTION REVIEWED By <br />Request by Elk River Development Authority for Cal Portner, Ci Administrator <br />Administrative Subdivision for Lot 1, Block 1, Northstar REVIEWED BY <br />Business Park <br />ACTION REQUESTED <br />Approve the administrative subdivision as presented. <br />BACKGROUND/DISCUSSION <br />The Elk River Economic Development Authority (EDA) owns lot 1, block 1 of Northstar Business Park. <br />An adjacent business has expressed interest in obtaining a portion of the lot, as they do not require the <br />entire parcel for their expansion needs. At the January 9, 2012, meeting, the EDA directed staff to <br />process the split. <br />The administrative lot split, authorized by section 30-391, results in a certificate of survey and allows for <br />the subdivision of land that was not the result of a previous administrative subdivision, creates four or <br />less lots, and does not require right-of--way. <br />The EDA proposes the creation of two parcels. Parcel A, the northernmost of the two, is 7.33 acres. <br />Parcel B is 4.8 acres. Both lots maintain frontage on a public street and include the minimum size (one <br />acre). <br />Access <br />Access to both sites will be via Tyler Street. An ingress and egress easement is proposed along the <br />northern 66-feet of Parcel B to the benefit of Parcel A. Staff recommends access control from Twin <br />Lakes Road, as that road was not designed nor intended for direct access. <br />Easements <br />It is customary that a utility and drainage easement be provided over a shared property line. Additionally, <br />a utility easement will be needed to protect the proposed relocated storm sewer that currently runs along <br />the southern boundary of the project (To facilitate the expansion of the building on the adjacent lot.) <br />These two easements can be recorded together when the lot is sold. <br />Park Dedication <br />Section 30-327 (d) does not require additional park dedication where park dedication has been previously <br />paid. <br />!' i • E 't~"E II 9 1 <br />A ll <br />
