Independent mmissions <br />Minnesota statutes uthorize the Council to create independent citizen b ards and <br />commissions. The a ount of discretionary power the Council can give such bodies varies. <br />The City of Elk River as the following four: <br />^ The Economic D velopment Authority (EDA) is established as authorized by <br />Minnesota Statutes, ections 469.090-469.108, to include, b not be limited to, <br />promoting commerc 1 and industrial growth and develop nt in the City of Elk <br />River. <br />^ The Housing and Redev opment Authority (HRA) in a for the City of Elk River <br />was created by an act oft Legislature of the State of innesota entitled the <br />"Municipal Housing and R development Act," Minnes to Statutes, Sections <br />469.001-469.089. The HRA ay not transact any busi ess or exercise any powers <br />until the Council, by resolutio ,finds the city has su tandard, slum, or blighted <br />areas that cannot be redevelop d without governme t assistance; or, has a shortage <br />of decent, safe, and sanitary low income dwellings. <br />^ The Elk River Public Library Boar~of Directors/ls established as authorized by <br />Minnesota Statutes, Sections 134.0 134.15. <br />^ The Utilities Commission is establishe as au orized by Minnesota Statutes, <br />Sections 412.321-412.391. This statute fives e Utilities Commission all <br />discretionary authority necessary to oper to e utilities. <br />This Advisory Board and Commission Policy app s to each of these groups as appropriate <br />and as permitted by the laws and ordinances that s bush them. Nothing in this policy is <br />intended to supersede any provision in state law r c code. To the extent that there is any <br />conflict between state law or city code with the;. rovis ns of this policy, state law or city <br />code shall prevail. Nothing in this policy is mt nded to ~ ~t, expand, or otherwise modify <br />the authority given to city boards and commssions by st to law or city code. <br />Commission Organization and Pr edures <br />I. Applications <br />All applicants, including boa .and commission membe s who are seeking <br />reappointment, must comp to an "Application for App ~ tment to City Board or <br />Commission" and submit e application to the City Cler by the deadline date. <br />2. Notification of Openi gs <br />Except for openings filled by Mayoral appointment, board an commission <br />expirations and va ancies will be advertised in the Elk Kiver Sta Neavs, The Current <br />newsletter, ERtV 12, and the city website. <br />t <br />3. Appointments <br />._i The Council will review all applications.
