Preliminary Plat of Orono Shores <br />12/19/97, page 2 <br /> <br />requirements of both residential and commercial PUD. The standards for stormwater <br />management require that there be no more than 25% total impervious area within tier 2 and 3. <br />The current proposal exceeds this requirement. In tier 1, the residential PUD language allows <br />deviation from this standard with an approved stormwater management plan. The proposal was <br />developed with a stormwater management system which incorporates sufficient ponding to <br />adequately treat the generated runoff of the site. This deviation from the standards needs to be <br />addressed, most likely with a variance. If the Board of Adjustment found that a variance was <br />justified we would not object. However, stormwater management practices should be sufficient <br />to have no net change on the rates and qualities of runoff from the site than would have been <br />allowed if developed according to the standard. <br /> <br />Lastly, the ordinance requires that there be agreements and restrictions in place governing open <br />space and common area, maintenance and preservation. I am not sure if these have been drafted <br />at this time. However, I recommend that any approvals be issued under the condition that these <br />items need to be reviewed and approved by the City prior to final recording. <br /> <br />Thank you again for the chance to review the project. I appreciate your work on trying to <br />balance the complexities of a mixed use PUD as well as the other City code requirements. This <br />proposal has been greatly modified from it's original form and appears to strike a balance. The <br />PUD requirements have worked well in numerous projects around the state, when the level of <br />development is matched to the site characteristics. This site has some significant limitations for <br />the level of development originally anticipated, which increased the amount of frustration and <br />tension within the process.
