The license issued under this subdivision authorizes the sale of table, sn~ g, <br />or fortified wines produced by the wineries at on sale by the glass,~rovided that no more than <br />two glasses per customer may be sold~and the dispensing of free samples of the wines offered <br />for sale within designated premises of the festival. A license is subject to all laws and ordinances <br />governing the sale, possession, and consumption of table, sua~ rkling, or fortified wines. For <br />purposes of this subdivision, a "bona fide association of owners and operators" means an <br />association of more than ten wineries that has been in existence for more than two years at the <br />time of application for the temporary license. <br />~ License restrictions. <br />l-a. The city may not issue more than three four-day, four three-day, six two-day, or 12 one-day <br />temporary licenses in any combination not to exceed 12 days per year for the sale of alcoholic <br />beverages to any one organization or for any one location, within a 12-month period. <br />2b. The city may not issue more than one temporary license for the sale of alcoholic beverages <br />to any one organization or for one location within any 30-day period unless the licenses are issued in <br />connection with an event officially designated a community festival by the city. <br />E Insurance. The council may, but at no time shall it be under any obligation whatsoever to, <br />grant a temporary on-sale intoxicating liquor license or temporary on-sale 3.2 percent malt liquor <br />license for premises owned or controlled by the city. Any such license may be conditioned, <br />qualified or restricted as the council sees fit. If the premises to be licensed are owned or under <br />the control of the city, the applicant shall file with the city, prior to issuance of the license, a <br />certificate of liability insurance coverage in at least the sum of 500 000 ~~AA;89&88 for injury to <br />any one person, 500 000 ~~S9;9A9:A8 for injury to more than one person, and 500 000 <br />;9A9:A9 for property damage, naming the city as an insured during the license period. <br />Section 2. Section 6-52 (9) & titled, Brewer Taproom Licenses, of the City of Elk River Code <br />of Ordinances shall be added as follows: <br />Breaver Taproom License <br />A brewer taproom license authorizes on-sale of malt liquor produced by a state licensed brewer <br />for consumption on the premises of or adjacent to one brewery location owned by the brewer. <br />Elieibility. <br />1. A brewer matey have one taproom license and may not have an ownership, interest in <br />another brewerv. <br />2. A brewer taproom license may not be issued to a brewer if the brewer seeking the license or <br />any person having an economic interest in the brewer~seekin~ the license is a brewer that <br />brews more than 250,000 barrels of malt liquor annually or a winery that produces more than <br />250,000 gallons of wine annually <br />Sec. 6-58. -Liability insurance. <br />(a) Kequired.
