RESOLUTION I I - <br />A RESOLUTION FOR THE CITY OF ELK RIVER <br />A RESOLUTION ADOPTING AND LEVYING ASSESSMENTS <br />FOR ABATEMENT OF CITY CODE VIOLATIONS <br />WHEREAS, Minnesota Statutes Section 429.101 authorizes the Ciry to levy an assessment <br />equal to the cost of abatement for removal or correction of a hazardous <br />condition; and, <br />WHEREAS, the City's ordinance Section 46-38 authorizes the City to levy an assessment <br />against property for any costs the Ciry incurs to abate a public nuisance; and, <br />WHEREAS, all customers and property owners with public nuisance violations have been <br />given adequate notice of this pending assessment and have been given <br />opportunities to pay prior to this assessment being levied; and, <br />WHEREAS, State law does not require a public hearing or notice before levying such <br />assessments. <br />NOW, THEREFORE, BE IT RESOLVED by the Ciry Council of the City of Elk River that <br />the parcels and amounts listed on Exhibit A attached hereto, are correct and made a part hereof, are <br />to be levied and axe to be certified to the Sherburne County Auditor. <br />Passed and adopted by the Ciry Council of the City of Elk River this 21S` day of November, 2011. <br />John Dietz, Mayor <br />ATTEST: <br />Tina Allard, Ciry Clerk <br />C:\Users\jjohnson\AppData\Local\Microsoft\Windows\Tempordry Internet Files\Content.0utlook\SFWAYSNS\2011 Council <br />Memo.docx\Code Violations 2011\2011 Council Memo <br />
