Howard R, Green Gompany <br />September 4, 2003 <br />File: 815791J-O030 <br /> <br />Item 5.4. <br /> <br />The Honorable Mayor and City Council <br />City of Elk River <br />13065 Orono Parkway <br />Elk River, MN 55330 <br /> <br />RE: <br /> <br />CASCADE INDUSTRIAL PARK <br />PUBLIC IMPROVEMENTS <br /> <br />Dear Council Members: <br /> <br />On Tuesday, September 2, 2003, City staff met with the developers of-Cascade Industrial Park <br />located in the southeastern part of the City, regarding potential public improvements to construct the <br />streets and storm drainage system. Staff provided the developers with a blank Petition, Waiver and <br />Agreement for Installation of Public Improvements and Assessment of the Cost Thereof, as prepared <br />by the City Attorney for just such a request. Attached is a copy of the executed petition. At this time, <br />this does not constitute an adequate petition, because a couple of blanks are not filled in correctly, <br />and the attached petition is not properly signed by an officer of the corporation. I have been in <br />discussions with the developers of Cascade Industrial Park and anticipate that we will have a fully <br />executed adequate petition by Monday evening. <br /> <br />Staff is in support of the developer's request to have the public improvement process utilized to install <br />the streets and storm drainage system in the industrial park. Lori Johnson, Finance Director, has <br />indicated that she is currently working on a bond request for other public improvements in the City and <br />could easily add this project to that bond request. She has also indicated to the developers that she <br />would recommend up to a seven-year period for repayment of theassessments. <br /> <br />If the City Council concurs and would like to initiate the public improvements in Cascade Industrial <br />Park based on an adequate petition being available for the City Council at Monday evening's meeting, <br />attached are two resolutions the Council should consider adopting. The first declares the adequacy of <br />the petition for improvement and orders the preliminary feasibility report. The second orders the <br />preparation of plans and specifications. The developer has indicated in discussions with staff that <br />they have a potential user ready to occupy the industrial park and are very interested in having the <br />improvements in place by this fall. This short time schedule requires that we present a resolution <br />authorizing the preparation of plans at the same the feasibility is initiated. <br /> <br />If you have any questions regarding this issue or either resolution, I will be in attendance at your <br />September 8, 2003 City Council meeting. <br /> <br />Sincerely, <br /> <br />Howard R.
