MEETING OF THE ELK RIVER BOARD OF ADJUSTMENTS <br />• HELD AT ELK RIVER CITY HALL <br />TUESDAY, AUGUST 9, 201 I <br />Members Present: Chair Ives, Commissioners Anderson, Johnson, Lemke, Scott and Westberg <br />Members Absent: Commissioner Bell <br />Staff Present: Planner/Park Planner Chris Leeseberg, Recording Secretary Debbie Huebner <br />Call Meeting To Order <br />Pursuant to due call and notice thereof, the meeting of the Elk River Board of Adjustments was <br />called to order at 6:30 p.m. by Chair Ives. <br />2. Consider 8/9/ 11 Board of Adjustments Agenda <br />MOVED BY COMMISSIONER LEMKE AND SECONDED BY COMMISSIONER <br />ANDERSON TO APPROVE THE AUGUST 9, 2011 BOARD OF ADJUSTMENTS <br />AGENDA. MOTION CARRIED 6-0. <br />3. Consider Request byJerome and Jean Hendricl~. 21144 Twin Lakes Road for Variance -Accessory <br />Structure Regulations. Public Hearing -Case No. V 11-01 <br />• Mr. Leeseberg presented the staff report. He stated the subject property is 18.28 acres in size and <br />reviewed the maximum allowed size and number of accessory structures currently allowed bythe <br />city's ordinance. He noted that the applicant currentlyhas four existing accessory structures, totaling <br />14,876 square feet. Removal of the subject garage and replacing it with a larger structure would <br />increase the total square footage to 16,040 square feet. He stated that based on the current <br />ordinance, staff would need to recommend denial. He noted that an ordinance amendment relating <br />to variances will be reviewed and acted on by the City Council prior to review of this application. <br />Chair Ives opened the public hearing. <br />Jerome Hendricl~, applicant - explained whyhe has not been able to replace the garage until now <br />and the circumstances regarding his daughter's medical condition of limited mobility. He stated that <br />the proposed new garage would allow her to park closer to the house, and the increased size would <br />provide room for physical therapy. Mr. Hendrickx explained that the parcel was originally 20 acres in <br />size, but that a portion was taken bythe county for right-of-wayto relocate and widen the county <br />road. He stated that it would be more cost-effective to build a new building than to repair the <br />existing building. <br />Melissa Phillips, 9630 213 Avenue, adjacent neighbor, stated she has no issues with the Hendrickx's <br />request, since it is the closest building to the house and will address their daughter's needs. <br />Commissioner Westberg asked when the county road was rebuilt. Mr. Hendrickx stated the road was <br />rebuilt in 2005 to take out the sharpness of the curve. <br />• <br />
