Changes In Eminent <br />Domain Law <br />^ Overview <br />^ Effective date for new law is May 20, <br />2006 <br />^ Minnesota Statutes Chapter 117 <br />preempts all other laws that govern <br />eminent domain proceedings <br />• Except for authorized takings for drainage <br />or town roads, or actions taken by <br />watershed districts or drainage authorities <br />Limited to Public Use or <br />Public Purpose <br />^ Public Use is defined as: <br />^ Possession, occupation, ownership and <br />enjoyment of the land by the general public or <br />public agencies <br />^ Creation or functioning of a public service <br />corporation (public utility, gas, electric, <br />telephone, cable communications company, <br />etc); or <br />^ Mitigation of a blight area, remediation of an <br />environmentally contaminated area, reduction <br />of abandoned property, or removal of a public <br />nuisance <br />2 <br />
