However, based on the drainage issue staff is <br />recommending the plat be redesigned and presented to the Planning <br />Commission at the November meeting. If the Commission wishes to take <br />action, the following conditions are recommended: <br /> <br />o <br /> <br />o <br /> <br />10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />A DEVELOPER'S AGREEMENT BE PREPARED AND EXECUTED OUTLINING THE TERMS <br />AND CONDITIONS OF ALL THE IMPROVEMENTS. <br /> <br />COMMENTS OUTLINED IN THE CITY ENGINEER'S MEMO DATED OCTOBER 24, 1997 BE <br />ADDRESSED AND INCORPORATED INTO THE PLANS. <br /> <br />DEVELOPER BE RESPONSIBLE TO CONSTRUCT A 10 FT. WIDE BITUMINOUS PATH <br />ALONG THE NORTH SIDE OF THE SERVICE ROAD. A CREDIT OF $10 PER LINEAL FOOT <br />FOR THE TRAIL WILL BE CREDITED TOWARDS THE DEVELOPER'S PARK DEDICATION. <br /> <br />WATER AVAILABILITY CHARGE IN THE AMOUNT OF $300 PER LOT BE PAID TO ELK <br />RIVER MUNICIPAL UTILITIES. DEVELOPER SHOULD ALSO CHECK WITH ELK RIVER <br />MUNICIPAL UTILITIES FOR ANY ADDITIONAL CHARGES RELATING TO WATER <br />CONNECTION OR ELECTRIC FEES. <br /> <br />A SURFACE WATER MANAGEMENT FEE IN THE AMOUNT REQUIRED BY THE CITY AT THE <br />TIME OF FINAL PLAT BE PAID PRIOR TO RECORDING THE PLAT. <br /> <br />PARK LAND IN THE AMOUNT OF 2 ACRES BE DEDICATED WITH THE BALANCE OF THE <br />PARK DEDICATION REQUIREMENTS BE PAID IN CASH. THE 2 ACRES DEDICATED FOR <br />PARK SHALL NOT INCLUDE ANY PONDING AREA. <br /> <br />A LANDSCAPE PLAN BE PROVIDED ILLUSTRATING A BUFFER ALONG THE WEST <br />PROPERTY LINE AND ALONG THE SOUTH ADJACENT TO THE SERVICE ROAD. <br /> <br />AN NPDES PERMIT BE OBTAINED PRIOR TO ANY GRADING OF THE SITE. <br /> <br />A COMPLETE GRADING, DRAINAGE AND EROSION CONTROL PLAN BE APPROVED BY <br />THE CITY ENGINEER PRIOR TO COMMENCING GRADING ON SITE. <br /> <br />STREET LIGHTS BE INSTALLED AS RECOMMENDED BY ELK RIVER MUNICIPAL UTILITIES. <br /> <br />APPROVAL FROM THE DNR SHALL BE OBTAINED ACKNOWLEDGING THE PLAT MEETS <br />THEIR REQUIREMENTS. <br /> <br />APPROPRIATE DRAINAGE AND UTILITY EASEMENTS BE INCLUDED ON THE PLAT. <br /> <br />A DEVELOPMENT PLAN BE PROVIDED AND REVIEWED AND APPROVED BY THE CITY <br />ENGINEER PRIOR TO ISSUANCE OF ANY BUILDING PERMITS. <br /> <br />THE PLAT SHALL BE REDESIGNED TO INCREASE THE REAR YARD AREA BEHIND LOTS 1 <br />THROUGH 6, BLOCK 4 AND LOTS 13 THROUGH 22, BLOCK 5. <br /> <br />f:\shrdoc\planning\pc\p97-16.doc <br /> <br /> <br />
