completely filled with Mixed Solid Waste, and could discourage the type of high quality <br />commercial/industrial development which the City is seeking for the important area of the City <br />immediately surrounding the Tiller Property, including the critical area around the future <br />interchange at Highway 169 and 221st Avenue. <br />23. The City Council also recognized that there are some positive economic impacts <br />related to the Landfill, including the fees which the City collects from the Landfill and the <br />business which ERL does with local residents and businesses, and that ERL and WMI have been <br />excellent corporate citizens and have made every effort to mitigate the impacts of the Landfill on <br />the City. <br />24. The City Council finds that the 2011 Application addresses the concerns which <br />caused the 2009 Application to be denied, because: <br />a. The 2011 Application commits to an expansion of no more than 31.8 acres <br />and provides that ERL and WMI will forever waive their right to pursue any further <br />Landfill expansion in the City. This is significant because it preserves over 60 acres of <br />land at the future interchange of Highway 169 and 221st Avenue for future development. <br />This will preserve the opportunity to generate tax base from this area and address the <br />negative economic impacts which caused the 2009 Application to be denied. <br />b. The 2011 Application commits to a closure date for the Landfill of no later <br />than December 31, 2030. This is significant because it sets an absolute deadline for when <br />negative impacts on the City related to operation of the Landfill will end. <br />c. The 2011 Application provides for an Expansion Fee which will assist in <br />offsetting the negative economic and other impacts of the Landfill on the City. <br />-8- <br />
