Request by Elk River Landfill, Inc. for a Solid Waste <br />Facility License to Operate the Existing Landfill and <br />the 31.8 Acre Ex ansion <br />Action Requested <br />Staff and the Planning Commission are recommending the City Council approve Elk River Landfill's <br />requests for a Land Use Amendment, to change the Land Use from Mining to Landfill; for a rezoning, to <br />rezone from Al (ME) Agricultural Conservation (Mineral Excavation) to Al (SWF), Agricultural <br />Conservation (Solid Waste Facility); and a Conditional Use Permit and Solid Waste Facility License to <br />expand the existing landfill onto 31.8 acres of property located immediately south of the existing landfill. <br />Background/Discussion <br />Elk River Landfill, Inc. (Landfill) is requesting a Land Use Amendment, Zone Change, Conditional Use <br />Permit and Solid Waste Facility License to expand the Landfill onto 31.8 acres of property located <br />immediately south of the existing landfill property. This proposal would allow for the development of <br />additional landfill space on 8.9 acres of the southern-most portion of the existing landfill property, and on <br />18.3 acres of the northern-most portion of the property owned by Tiller Corporation ("Tiller Property"), <br />which is located immediately to the south of the existing landfill property, for a total of 27.2 acres of <br />additional fill area. An additional 13.5 acres of the Tiller Property will be required for the 200 foot buffer <br />area. Therefore, 31.8 acres of the Tiller Property will be permitted for Landfill operations. <br />33 acres of Tiller Property would be reguided from Mining to Landfill and rezoned from AI (ME) to Al <br />(ME) (SWF).
