already guided for "mining," which is an industrial use, and landfilling is, per the EIS, an <br />industrial use. <br />The SWF Overlay District is compatible with the underlying Agricultural Conservation zoning <br />district since the existing Landfill is zoned Agricultural Conservation and SWF Overlay District. <br />^ How compatible is it with surrounding properties? <br />Adjacent land uses include TH 169, landfill, mining, the City's Railroad Hiking Trail, and rural <br />residential uses. The EIS found that °the proposed Landfill expansion is compatible with the <br />existing land uses in the project area which are primarily undeveloped or industrial (i.e., mining, <br />landfill) in nature" (pg. 80). <br />In accordance with the May 25, 2011 Agreement, ERL intends to provide a variety of trees along <br />the perimeter berm of the expanded Landfill, southern and western access roads, and the future <br />sedimentation ponds. A 200-foot buffer will also be maintained between the landfill footprint and <br />property boundary. <br />The open space end use planned for the site would be compatible with any adjacent future <br />development. Any future end use plans will be in accordance with the May 25, 2011 Agreement. <br />^ What are the benefits to the city? <br />Benefits include: <br />,~~' Landfill support of local businesses <br />`' Landfill donates to local charities <br />Property tax revenue <br />Local employment <br />City Host Fees in accordance with the May 25, 2011 Agreement <br />Fees to Sherburne County, including the Landfill Legacy Grant <br />Future open space <br />Green power generation <br />3.2 ZONING AMENDMENT CONSIDERATIONS <br />The Elk River Code, Chapter 30. Land Development Regulations, Article VI. Zoning, Division I. <br />Generally, Section 30-575. Amendments, provides the considerations for reviewing zoning <br />amendments required findings: <br />Sec. 30-575, Amendments. <br />(e) Action by council. Fol%wing planning commission consideration or the expiration of its <br />review period, the council may hold such pub/ic hearings to consider the amendment as it deems <br />advisable, Fol%wing the conclusion of the hearings, if any, the council may adopt the <br />amendment, or any part thereof, in such form as it deems advisable, reject the amendment, or <br />refer it to the p/arming commission for further consideration.
