SECTION 2 <br />_. <br />Land Use Application Requirements <br />2.1 INTRODUCTION <br />City staff has indicated that a comprehensive plan amendment is needed to extend the "landfill" <br />designation to 31.8-acre portion of the SDA which is part of the expanded Landfill and its buffer. <br />While it does not believe that a comprehensive plan amendment is required, ERL, at City's <br />request, seeks such an amendment. The expanded Landfill will also require the 31.8-acre portion <br />of the SDA which is part of the expanded Landfill and its buffer be rezoned to be included in the <br />SWF Overlay District and a sanitary landfill CUP will need to be obtained. <br />In addition to the application requirements established in the City Code, City has various land use <br />application forms that must be submitted with the land use applications. The applicable forms for <br />this application include the 2011 Land Use Application Form, Zone Change, Conditional Use <br />Permit and Land Use Amendment. The application requirements established by the City Code and <br />forms are detailed in this section. <br />2.2 ZONING AMENDMENT REQUIREMENTS <br />The Elk River Code, Chapter 30. Land Development Regulations, Article VI. Zoning, Division I. <br />Generally, Section 30-575. Amendments, governs the zoning amendment process and application <br />requirements: <br />Sec. 30-575, Amendments. <br />(a) Authorized. The counci/may, from time to time, by atwo-thirds vote of the entire council, <br />adopt amendments to this arti% including the zoning map. <br />(b) Initiation of proceedings. <br />(I) Proceedings to amend this artic% shall only be initiated by the council, the planning <br />commission or a petition of the property owners. <br />(2) An application for an amendment shat/ be filed with the director of planning, <br />Petitions by property owners requesting change in a district boundary shall be <br />accompanied by a map or p/at showing the /ands proposed to be changed and al/ /and <br />within 350 feet of the boundaries of the properly proposed for such rezoning together <br />with the names and addresses of the owners of /and in such area. <br />The Elk River Code, Chapter 30. Land Development Regulations, Article VI. Zoning, Division 10. <br />Overlay Districts, Section 30-1834. Solid Waste Facility (SWF) Overlay District, governs the use of <br />land for the establishment and operation of solid waste facilities and establishes the <br />administrative procedures: <br />Sec. 30-1834. SWFsolid waste facility over/ay district: <br />(d) Administrative procedures. Estab/ishment ofso/id waste faci/ity over/ayzoning on a specific <br />parcel of land shall be by amendment to the city's zoning map as provided by this artic% and <br />pursuant to the procedures set forth in Section 30-575.
