Due to the lateness of the meeting the Council <br />asked that this item be brought back for further discussion on October 27th. <br />Since last week's meeting, staff has had the opportunity to review further <br />and confirm the easement granted by Heritage Landing Partnership (Dennis <br />Chuba) to the City for drainage and utility purposes over Lots 1, 2, 3 and 4, <br />Block 1, Heritage Landing 2"d Addition is invalid on Lot 3. The following is a <br />sequence of events leading up to the easement granted to the City: <br /> <br />5/1/95 - Contract between Anderson's and Harold Gramstad for the <br />purchase of property and the building of a home. Down payment on the <br />lot paid by the Anderson's. <br /> <br />· 7/25/95 - Warranty Deed transferred from Heritage Landing Partnership <br /> to Harold Gramstad and recorded on 8/4/95 (Document #312385). <br /> <br />· 7/27/95 - Anderson's have paid remainder of cost for lot to Harold <br /> Gramstad. <br /> <br />8/7/95 - Anderson's receive Warranty Deed to Lot 3, Block 1, Heritage <br />Landing 2na Addition from Harold Gramstad and deed is recorded on <br />10/2/95 (Document #315206). <br /> <br />9/25/95 - Grant of Easement document is signed by Dennis Chuba of <br />Heritage Landing Partnership and recorded at the County on 10/11/95 <br />(Document #315724). <br /> <br />The above sequence of events clearly indicates that Heritage Landing <br />Partnership did not own Lot 3, Block 1, Heritage Landing 2nd Addition when <br />the easement document was signed and recorded.
