<br />.31 Sec. 11. Minnesota Statutes 2004, section 163.12, subdivision lb, is a
<br />Subd. lb. Finding of necessity. When proof of service of the notice re

<br />by condemnation under this section may include a
<br />8. 23 property devoted to a public use, whether or not held in trust, notwithsta
<br />8. 24 property may have been previously acquired by condemnation or is owned by
<br />8. 25 utility corporation, because the public use in conformity with the provisi
<br />8. 26 469.001 to 469.047 shall be deemed a superior public use. Property devote
<br />8. 27 use may be so acquired only if the governing body of the municipality has
<br />8. 28 its acquisition by the authority.
