Planning Commission Minutes <br />April 12, 2011 <br />Page 2 <br />Commissioner Bell asked why a CUP was needed. Mr. Barnhart stated that hotels are a <br />conditional use in the C-3 zoning district. 'He added that the property is also part of the • <br />FAST study area and the proposed use is consistent with the plan that was approved. <br />Vice-Chair Anderson asked if the property may be impacted by any MnDOT changes. Mr. <br />Barnhart explained where an access point on Highway 10 will be closed, noting that this <br />change will not affect the use of this parcel. <br />Commissioner Lemke asked if only city water was available to the site, as referenced in <br />Condition #6. Mr. Barnhart stated that the property should be hooked up to city water and <br />sewer services. <br />Vice-Chair Anderson opened the public hearing. <br />John Shrieber, 16271 Royal Road, Ramsey, property owner -stated that the hotel <br />was closed due to lack of operating capital. He noted that the property is currently hooked <br />up to city water and sewer. He stated that the hotel would reopen as it was in the past. <br />Vice-Chair Anderson asked is there currently is a trail easement on the property along the <br />Mississippi River. Mr. Shrieber stated that there was no easement when he acquired the <br />property in 1991. He stated he would not object to an easement along the river for a trail <br />and felt it would be good exposure for the business. <br />Mr. Barnhart reviewed the seven conditions listed in the staff report at this time. <br />Mr. Shrieber stated that he did have a problem with Condition #4 regarding guests • <br />occupying the hotel longer than 30 days. He stated that in the past, they had a few people <br />that would contract with the hotel for longer than 30 days while in the area for business. He <br />requested that Condition #4 be struck from the conditions of approval. He explained a <br />sales tax issue when guests stay longer than a specified time period. Mr. Barnhart noted that <br />this concern would be reflected in the minutes. He stated that further research would be <br />done regarding R1 and R2 construction building code issues that may need to be <br />considered, and this information would be made available for the City Council's review of <br />this matter. <br />Commissioner Lemke stated that he had not concerns with the request and felt it would be <br />good to see the hotel reopen. <br />Vice-Chair Anderson stated that he would like input from the Parks and Recreation <br />Commission regarding a trail easement. Mr. Barnhart stated that the Planning Commission <br />could suggest a trail easement be recommended, in conjunction with the FAST study. <br />Commissioner Westberg asked if any improvements were made, what the setbacks would be. <br />Mr. Barnhart stated that no expansion is being proposed. He noted that if there is any <br />conflict currently with setbacks, they would be grandfathered in, and if an addition was <br />proposed in the future, setbacks could be looked at, at that time. Commissioner Westberg <br />stated that he supported the request. <br />• <br />
