d. any folding structure, mounted on wheels and designed for travel, recreation, <br />and vacation use. <br />The key language in the Statute is that "recreational camping areas" are areas used <br />exclusivelX for tents and recreational camping vehicles; and that "recreational camping <br />vehicles" are vehicles designed to be used as a "temporary dwellixlg" for "travel, recreational, <br />and vacation uses." <br />Attached to the staff report and incorporated into the record of proceedings on the potential <br />revocation of the conditional use permit for Wapiti Park Campground are the staff reports <br />and minutes of Planning Commission and City Council meetings over the past year <br />regarding Wapiti Park. Also attached are reports from City planning staff, environmental <br />staff, building inspection staff, and the police department. Included in this record is the <br />following evidence regarding whether use of the vehicles and structures at Wapiti Park is for <br />"travel, recreation, and vacation uses": <br />^ Several current residents have indicated in their testimony to the Planning Commission and <br />City Council, and to police officers taking reports that they make their permanent residence <br />at Wapiti Park Campground; <br />^ Sherburne County has confirmed that at least four vehicles at Wapiti Park Campground are <br />not licensed for travel on public roads; <br />^ The Sherburne County Probation has reported that in the past five years 23 probationers <br />have identified Wapiti Park as their permanent residence; <br />^ At least two of the vehicles at Wapiti Park have permanent additions attached to the vehicles <br />(including one vehicle with two additions), indicating that they are not intended for travel, <br />recreation, and vacation. These structures are also in apparent violation of the State Building <br />Code; <br />^ Several vehicles apparently have wheels removed, which violates a specific condition of the <br />conditional use permit and indicates that the vehicle is not intended for travel, recreation, or <br />vacation use. Other vehicles have permanent skirting which makes it impossible to <br />determine if the wheels are removed, and also indicates that the vehicle is not intended for <br />travel, recreation, or vacation uses. <br />With respect to the protection of the public health, safety, morals, comfort, convenience, <br />and general welfare of the neighborhood and the City, the record indicates a number of <br />issues, including: <br />The safety of both the freestanding and attached structures at the campground. City records <br />do not show and building permit having been pulled for these structures, nor any <br />inspections having been done. These structures are a safety concern both from a structural <br />integrity standpoint and as a fire hazard. <br />The integrity of the septic system serving the campground. The owners of the campground <br />have refused to have the septic system inspected by a licensed inspector to confirm that it is <br />functioning and in compliance with state standards.
