Box 490 <br />Elk River, MN 55330-0490 <br /> <br />RE: <br /> <br />SIMONET DRIVE LEFT TURN LANE <br />TRUNK HIGHWAY 169 FENCING AND LIGHTING <br /> <br />Dear Council Members: <br /> <br />We have received from MnDOT the cooperative construction agreements for both the Simonet <br />Drive left turn lane construction and the Trunk Highway (TH) 169 fencing and lighting project. <br />We have reviewed both of these agreements and find them to be very similar to many of the <br />previous agreements that the City has entered into for joint projects with MnDOT. Both <br />agreements spell out that the projects are 100% funded by MnDOT. With the Simonet Drive <br />project we have a separate agreement that spells out reimbursement for engineering services. <br />The TH 169 fencing and lighting agreement indicates the state will pay 8% of construction cost <br />for engineering and construction services. <br /> <br />The one item in the TH 169 fencing and lighting agreement that is slightly different is the <br />maintenance of the improvements. As we discussed previously, MnDOT's 100% funding of the <br />improvement costs was conditioned upon the City accepting maintenance responsibility. With <br />regard to the fence that would include repair of any damage to the fence, grass mowing where <br />the fence is moved into the MnDOT right-of-way weed control and debris removal. With regard <br />to the lighting along TH 169, the City through this agreement is responsible for the reinstallation <br />of knocked down poles, repair of wiring, and the replacement of luminairs. The City is also <br />responsible for providing the necessary electrical energy to operate the lighting system. <br /> <br />Based on our review of these documents, we would recommend that the City Council adopt the <br />attached resolution. By adopting these resolutions, the City enters into this agreement and <br />instructs the Mayor and City Administrator to execute the agreements. <br /> <br />If you have any questions regarding these agreements, I will be in attendance at Monday <br />evening's City Council meeting. <br /> <br />Sincerely, <br /> <br />Howa~r.~LJ~Green Company <br />T~ rer, 'P.
