Box 490 <br />Elk River, MN 55330 <br /> <br />RE: <br /> <br />SHERBURNE COUNTY ADMINISTRATION BUILDING EXPANSION <br />PETITION FOR WATERMAIN AND ROADWAY <br /> <br />Dear Council Members: <br /> <br />At last Tuesday's County Board meeting, City Administrator Pat Klaers and I appeared on <br />behalf of the City to discuss the need for water improvements for fire fighting purposes and <br />roadway improvements for a secondary access to the County Administration Building in <br />conjunction with their planned expansion. At that Board meeting, the County Board voted <br />unanimously to petition the City for these improvements. At this point in time, we have not <br />received the signed petition from the County, but believe that it will be forthcoming. <br />Therefore, attached to this letter is a resolution which declares the adequacy of the County <br />petition and authorizes the feasibility study for the necessary improvements. <br /> <br />It should be noted that this project will entail crossing the Gagne property with lateral <br />sanitary sewer, trunk watermain, and street and storm drainage improvements to access <br />the Sherburne County site. There are currently no easements or road right-of-way <br />crossing the Gagne property. Therefore, if the City is unsuccessful in negotiating with Mr. <br />Gagne for these easements and/or road right-of-way, it may be necessary for the City to <br />use their powers of eminent domain to secure the necessary easements. It should also <br />be noted that these improvements that were petitioned by the County Board would also <br />entail lateral sanitary sewer and watermain assessments along with street and storm <br />drainage assessments against the Gagne property. Staff felt it was imperative that the <br />County petition for watermain and street improvements prior to a building permit being <br />issued for the expansion of their facility because of the need for fire protection and a <br />secondary access to the signalized intersection at TH 10 and Joplin Street.
