PWA ON$ Ill. <br />9. Describe how "public access to the data would render unworkable a program authorized by law." <br />(Minnesota Statutes Section 13,06, subdivision 3 (b).) Describe the program and cite the <br />statute or federal law which authorizes it. <br />It is not sufficient merely to affirm that public access to the data would render the program <br />unworkable. You are required to describe the nature of the threat to the program and cite facts to <br />support your assertions. Identify and describe specifically the adverse effects, sequences of events <br />or cause -and -effect relationships that would make the program unworkable. If relevant, cite any <br />past instances where release of this kind of data to the public has rendered a program unworkable. <br />10. In order to establish, pursuant to Minnesota Statutes Section 13.06, subdivision 3 (c), "that a <br />compelling need exists for immediate temporary classification," describe how release of the data <br />"could adversely affect the health, safety, or welfare of the public." <br />To establish a compelling need for a classification of data as nonpublic, you must detail the adverse <br />effects of releasing the data to the public. To establish a compelling need for classifying the data <br />as protected nonpublic, you must describe the adverse effects if the data were released not only to <br />the public but to the data subject as well. <br />Consult with your legal advisor about the meaning of the term, "compelling need." It is not <br />sufficient merely to affirm that a compelling need exists. You are required to state explicitly the <br />nature of the compelling need and to cite facts supporting your assertions. Be as specific as <br />possible in identifying adverse effects, sequences of events or cause -and -effect relationships. If <br />relevant, cite any instances in the past where release of this kind of data to the public has adversely <br />affected the health, safety, or welfare of the public. <br />I affirm that all of the above statements are true to the best of my knowledge.
