Complete this application by providing all the information requested. Where this <br />application does not provide enough space to answer a question, please complete your answer on a separate <br />sheet, identify it by question number, and attach the sheet(s) to this application. Submit the completed <br />application to: Commissioner, Department of Administration, 200 Administration Building, 50 <br />Sherburne Avenue, St. Paul, Minnesota 55155. <br />It is strongly recommended that you prepare this application in consultation with your legal advisor. <br />Preparation of responses to certain questions, such as those concerning "compelling need," requires <br />knowledge of legal standards for which legal guidance is indicated. <br />The Public Information Policy Analysis Division of the Department of Administration will conduct a <br />preliminary review of your application to make sure it is complete and in compliance with statutory <br />requirements. The purpose of this review is to ensure the application makes a sound argument in support of <br />a temporary classification so that it is not disapproved by the Commissioner because of technical or <br />procedural problems. <br />If any problems come to light during the review, you will be advised how to bring the application into <br />compliance with statutory requirements. You may be asked to submit additional information in support of <br />the application, or the application may be returned to you for revision. When your application is complete <br />and meets all statutory requirements, it will be reviewed by the Commissioner. <br />Pursuant to Minnesota Statutes Section 13.06, subdivision 1, if you file a new application, the data for which <br />a private or confidential classification has been requested will receive the requested classification for a period <br />of 45 days, or until the Commissioner approves or disapproves the application (whichever is earlier). In the <br />case of an amended application, the time period is 20 days. <br />Pursuant to Minnesota Statutes Section 13.06, subdivision 4, the Commissioner may consider a new <br />application for statewide applicability. Should the Commissioner deem this approach advisable, the data for <br />which the classification is requested will receive the requested classification for a period of 90 days, or until <br />the Commissioner approves or disapproves the application (whichever is earlier). In the case of an amended <br />application, the time period is 20 days. <br />THE APPLICATION YOU SUBMIT IS A PUBLIC RECORD. A copy will be sent to members of the <br />media community and to others who have requested receipt of copies.
