CHALLENGING THE ACCURACY AND COMPLETENESS OF DATA <br />IA. Right to Contest. I <br />An individual subject of data may contest the accuracy and completeness of public and private <br />data concerning him/herself. <br />B. Procedure for Contesting Accuracy or Completeness. <br />1. Written Request Required. An individual who wishes to contest the accuracy and <br />completeness of public or private data about himJherself must submit a written notice to the <br />Responsible Authority. The written notice shall contain the following. <br />a. The name, address and phone number of the appealing party (provisions may be <br />made for an individual who wishes to remain anonymous). <br />b. A description of the claimed inaccuracy or incompleteness of the data in question. <br />C. A list of past recipients of the data, if any, that the appealing party wishes to have <br />notified, if the data is found to be inaccurate or incomplete. <br />2. Decision. Within 30 days, the Responsible Authority must either correct the data found <br />to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or incomplete <br />data, including recipients named by the individual, or notify the individual that the Responsible <br />Authority believes the data to be correct. (Minn. Stat. § 13.05, subd. 4) The Responsible <br />Authority should provide the data subject with: a written statement which informs the data subject <br />of his or her right to appeal; and a copy of Minnesota Rules, Part 1205.1600. <br />3. Right to Appeal. An adverse decision of the Responsible Authority regarding the <br />accuracy and completeness of public or private data may be appealed to the Commissioner of <br />Administration. A notice of appeal must be filed with the Commissioner within 180 days after <br />the Responsible Authority's decision or within 60 days if the Responsible Authority provides a <br />written statement which informs the data subject of his or her right to appeal. The procedures <br />for this appeal are contained in Minnesota Rules, Part 1205.1600. (Minn. Rules, Pt. 1205.1600, <br />subp. 2) <br />4. Correcting Data. When an individual successfully challenges the accuracy or <br />completeness of data about him/herself, the Responsible Authority must complete, correct, or <br />destroy the challenged data, without regard to the requirements of Minnesota Statutes, Section <br />138.17, The Responsible Authority may retain a copy of the Commissioner of Administration's <br />CAN50884 <br />GA115-26 43 <br />
