City Administrator/ <br />Finance Director <br /> <br />June 30, 1997 <br /> <br />Adoption of Data Practices Act and <br />Resolution Appointing Responsible <br />Authority <br /> <br />As you are aware, staff has been in the process of updating the City's Data <br />Practices policy. Peter Beck recommended that the City work with Corrine <br />Thomson, an attorney with Kennedy and Graven, because of her expertise in <br />the data privacy law. This project is now complete with the exception of a <br />resolution which needs to be approved by the Council. <br /> <br />Attached is a copy of the City of Elk River Guidelines and Procedures for the <br />Minnesota Government Data Practices Act. Both department heads and staff <br />have had training sessions with Ms. Thomson regarding the law and the <br />City's policy. This document is a helpful guide in determining what <br />information may be released and what may not. <br /> <br />Additionally, the law requires that the City appoint by name, not position, a <br />Responsible Authority. The Responsible Authority is the person charged <br />with administering the requirements for collection, storage, use and <br />dissemination of data on individuals. The attached resolution appoints Pat <br />Klaers as the Responsible Authority. <br /> <br />Action Requested <br /> <br />The Council is asked to approve the attached resolution appointing Pat <br />Klaers as the Responsible Authority for the data practices act and to approve <br />the newly drafted City of Elk River Guidelines and Procedures for the act. <br /> <br />13065 Orono Parkway · P.O.
