JUM-13-S7 FRI 10:27 AM SHKRBURNE COUMTY <br /> <br /> COUNTY'S ORDINANCE <br /> <br />FAX HO. 6122412707 <br /> <br />AN ORDINANCE ESTABLISHING A CURFEW FOR MINORS AND PENALTIES <br /> THEREFORE FOR THE MINORS AND THEIR PARENT(S) <br /> <br />Section 1. Purpose. This ordinance is enacted to ensure the safety of our youths in public <br />places in the Iate evening hours and early morning hours and to further provide accountability <br />of the youth and their parent(s) for the youth activities in our community. ' <br /> <br />'Comment: Minnesota Statute 145A.05, subd. 7a provides that a County Board <br />may adopt and ordinance establishing county wide curfew for persons under 17 <br />years' of age. Sherburne County is experiencing rapid growth rate and its <br />demographic show that the average age of the populous is younger than the state <br />average. The County is also experiencing an increase in its juvenile crime and <br />cases being handled in the Court system. <br /> <br />Section 2. Title. This ordinance shall be known and may be cited and referred to as the <br />"Sherburne County Curfew Ordinance," <br /> <br />Section 3, Validity. Should any section or provision ot this Ordinance be declared invalid by a <br />~:ourt of competent jurisdiction, such decision shNi not affect the validity of this Ordinance as & <br />whole or any part thereof other than the part so declared invalid. <br /> <br />Section 4. Jurisdiction. The jurisdiction of this Ordinance shall be county wide including <br />incorporated areas. <br /> <br />Section 5. Interpretation. In interpreting and applying the provisions of this Ordinance, they <br />shall be held to be the minimum requirements for the protection of the public safety and general <br />welfare. <br /> <br />Section 6. Definitions and Rules of Language <br /> <br />"Minor" means any individual who is under the age of 17 and has not been <br />declared by a court of competent jurisdiction as being emancipated. <br /> <br />ii. <br /> <br />"Parent" means any individual who is over the. age of 18 and is the birth or <br />adoptive parent of the minor, or who h~ the legal custody of the minor as <br />established by order of a court of competent jurisdiction. This definition excludes <br />individuals who are providing foster care as it is defined in Minnesota Statute <br />260.015, subd. 7. <br /> <br />iii. <br /> <br />Unless specifically defined he'rein, words or phrases used in this ordinance shall <br />be interpreted so as to give them the same meaning as they have in common <br />usage and so as to give this ordinance its most reasonable application. Words <br />used in the present tense shall include the future; words in the singular shall <br />include the plural; and the words "shall" and "must" are mandatory and not <br />cliscretJonary. <br /> <br />Sec_tion 7. Minors Curfew. It shall be unlawful for any minor who is unaccompanied by a parent <br />or an adult who does not have permission of the parent to be with the minor, to be present upon <br /> <br /> <br />
