ANALYSIS <br />The plans submitted with the application indicate that operation of the proposed facility will require <br />direct access onto TH 169. However, the applicant has not submitted any evidence that MnDOT has <br />approved access to TH 169, as required by Section 42-52(11). In addition, Section 42-78(1) of the City <br />Code provides that no extraction license or conditional use permit shall be issued until the applicant has <br />received approval from MnDOT fox access to TH 169. The application fails to meet these requirements <br />of the City Code. <br />In addition, the applicant has not completed the wetland impact process set forth in Section 30-1851 (d) <br />of the City Code, as required by Section 42-53(c). <br />RECOMMENDATION <br />Staff recommends that the Planning Commission recommend denial of the Elk River Investments/Tiller, <br />Corp. request for Mineral Excavation because the application does not comply with all of the <br />requirements of the City Code relating to haul roads, access and wetlands. <br />ATTACHMENTS <br />^ Location Map <br />^ Applicant's Narrative <br />^ Site Plan(s) <br />^ Mineral Excavation Ordinance <br />Action Motion by Second by Vote <br />Follow Up <br />
