ITEM 7.7.

ty of

iver

MEMORANDUM

TO:
FROM:
DATE:
SUBJECT:

Mayor and City Council

Steve Ach, City Planner_~~

April 21, 1997

Request to Vacate Drainage and
Utility Easements by Kraus-
Anderson of Elk River, Inc., Public
Hearing Case No. EV 97-2

Consider Resolution No. 97-__, vacating certain drainage and utility
easements within Elk Park Center Planned Unit Development.

Attachments

Resolution No. 97-
Location map
Exhibits illustrating easement to be vacated

Overview.

Kraus-Anderson is proposing to make an expansion to the north end of Cub
Foods which will be a slight modification of the development plans that were
originally approved for Elk Park Center. In order to facilitate this building
expansion, a 25' by 30' drainage and utility easement will need to be vacated.
This easement was originally platted with the Elk Park Center Planned Unit
Development. With the slight modifications that have taken place in
developing this center, the drainage and utility easement requested to be
vacated has no utilities nor a need for future utilities; therefore, can be
vacated.

Recommendation

It is recommended the City Council approve Resolution No. 97- , vacating
certain drainage and utility easements within Elk Park Center as illustrated
on Exhibit A in the attached resolution.

s:\council\ev97-2.doc

13065 Orono Parkway · P.O.
