Elk River City Council Minutes <br />April 21, 1997 <br /> <br />Page 5 <br /> <br />5.6. <br /> <br />Update on Appraisals and Consideration of Ordinance Amendinq Section 1010.12 <br />IManufactured Home Park Closinqs) of the City Code of Ordinances, Public <br />Hearinq Case No. GA 97-4 <br /> <br />City Planner Steve Ach slated that staff has worked with the City Attorney's office <br />to revise Section 1010.12 of the City Code regarding payment of additional <br />compensation. He indicated that the specific changes to the ordinance <br />included the following: 1.) clarifying that residents of the manufactured home <br />park have the choice whether to relocate their mobile home or choose to tender <br />title upon compensation, and 2.) the ordinance amendment will also provide <br />that the mobile home purchaser shall reimburse the city for any advances the <br />city makes for appraisal costs. <br /> <br />Mayor Duifsman opened the public hearing. There being no one for or against <br />the matter, Mayor Duitsman closed the public hearing. <br /> <br />COUNCILMEMBER FARBER MOVED TO APPROVE ORDINANCE 97-7, AN ORDINANCE <br />AMENDING SECTION 1010.12 OF THE CITY CODE OF ORDINANCES (MANUFACTURED <br />HOME PARK CLOSINGS) REGARDING PAYMENT OF ADDITIONAL COMPENSATION AS <br />STATED IN STAFF'S MEMO DATED APRIL 21, 1997. COUNCILMEMBER THOMPSON <br />SECONDED THE MOTION. THE MOTION CARRIED 5-0. <br /> <br />City Administrator Pat Klaers introduced Dwight Poss of Credit Resource <br />Management, the appraisal firm hired to complete work at the Elk Terrace Mobile <br />Home Park. <br /> <br />Dwight Poss updated the Council on the status of the appraisals and the work he <br />has completed. <br /> <br />Councilmember Holmgren thanked Dwight for his update and for the work he has <br />completed. <br /> <br />Heather Bergman, resident of Elk Terrace Mobile Home Park, asked if the Council <br />was aware of when the money would be available to the residents. Mayor <br />Duitsman indicated the city had no information at this time. <br /> <br />5.7. <br /> <br />Consider Request by Derrick Investment to Install Public Utilities Without Providinq <br />a Financial Guarantee <br /> <br />Pat Klaers explained Derrick Investment has requested the City Council deviate <br />from its policy of requiring full financial security before developers start a project. <br />Mr. Derrick indicates he has a contractor available to do work, but will not have <br />his bank financing in place until mid May. <br /> <br />It was noted that, as the Highland trunk water line is proposed to go through this <br />plat, the city and developer as partners in the grading aspect of this project. It <br />was the consensus of the City Council to allow Derrick Investment to do grading <br />on Phases II an III provided the plat is recorded and the grading plan is approved <br />by the city engineer. Also, the Mayor and Councilmembers were in agreement <br />to not allow utility pipes to be installed beyond Phase I until additional financial <br />security is placed with the city. <br /> <br /> <br />
