Island View Drive through the subdivision and ultimately connecting with <br />191st Ave. Obviously, Island View Drive being platted to the westerly hmits <br />indicates that the road was planned to be extended as well as 191st Ave. <br />which included an outlot which has been deeded to the city for future right of <br />way purposes. The residents from the Island View Drive area were opposed <br />to any extension as they felt it would increase the amount of traffic on Island <br />View Drive. To satisfy the emergency access concerns, staff has <br />recommended that these two roads be connected in a manor that will not <br />serve as a cut through or encourage any additional traffic, rather provide <br />another means of access to the Island View Drive area in the event of an <br /> <br />emergency. <br /> <br />Easements/Right-of-Way <br /> <br />Currently, Elk River Township road has 40 feet of right-of-way. Additional <br />right-of-way should be granted as part of this administrative subdivision to <br />accomphsh the full 60 feet in the event this roadway is ever upgraded to a <br />city standard. <br /> <br />Furthermore, appropriate drainage and utility easements should be provided <br />throughout the administrative subdivision. <br /> <br />Ownership <br /> <br />The survey that has been provided to the city for review includes several <br />notes at the bottom of the survey which suggest concerns regarding <br />ownership of the property. Apparently this property is going through the <br />Torrence proceedings at this time in an attempt to clear up any ownership <br />disputes that may exist on the property. Due to the amount of ownership <br />concerns that exist on the property, staff believes that before the City Council <br />acts on this administrative subdivision, the Torrence proceeding should be <br />completed to verify actual ownership of the property. Once the Torrence <br />proceeding is completed, staff would be in a better position to make <br />recommendations on the proposed subdivision. <br /> <br />Recommendation <br /> <br />It is recommended the City Council either have the apphcant agree to table <br />the administrative subdivision indefinitely and bring back this apphcation <br />back when the Torrence proceeding is completed, or deny the Administrative <br />Subdivision based on the following: <br /> <br />There is a significant ownership issue associated with the proposed <br />administrative subdivision that prevents a recommendation from <br />being made at this time. <br /> <br /> <br />
