Memo to the Mayor and City Council/Derrick Investment Request Page 3 <br />March 17, 1997 <br /> <br />The pedestrian and circulation needs were based on a project 55 years <br />and older. By eliminating the residency requirement, additional <br />sidewalk or trail connections may be necessary. <br /> <br />Off street parking needs wil! need to be provided. The change in <br />residency will once again have an effect on the number of cars each <br />resident will own and therefore the parking demands will change. <br /> <br />o <br /> <br />If the projects residency requirements are going to be eliminated, curb <br />and gutter should be installed throughout the entire project consistent <br />with other townhouse planned unit developments that have been <br />approved. <br /> <br />Recommendation <br /> <br />Staff believes the findings expressed by the Planning Commission are issues <br />which need to be consideration before acting on this request. The entire <br />review process focused on the project as a 55 year and older community and <br />along with that special considerations were given along the way. Certainly <br />the primary concerns relate to the traffic generated from the project and <br />providing an adequate number of access points to serve this project. Also, <br />pedestrian needs and on-site parking will need to be addressed. <br /> <br />If it is the desire of the Council to maintain this project based on the 55 year <br />and older, the Council certainly has the opportunity to deny Derrick <br />Investments request to change the residency requirement. The rezoning and <br />conditional use permit were both approved with the condition the project <br />would be for residents 55 years and older. <br /> <br />Council Action <br /> <br />ho <br /> <br />Consider denying Derrick Investment's request to amend the PUD <br />agreement based on the following findings: <br /> <br />TESTIMONY FROM ADJACENT RESIDENTS THAT WERE OPPOSED TO THE <br />CHANGE IN THE RESIDENCY REQUIREMENT. <br /> <br />THE INFORMATION THAT WAS SUBMITTED BY THE DEVELOPER FROM THE <br />BEGINNING WAS FOR A 55 YEAR AND OLDER TOWNHOUSE COMMUNITY. <br /> <br />o <br /> <br />BY CHANGING THE RESIDENCY REQUIREMENT THERE WILL BE AN INCREASE <br />IN TRAFFIC AND THE PROPOSED DESIGN WILL NOT BE ADEQUATE TO <br />HANDLE THE CHANGE IN TRAFFIC PATTERNS. <br /> <br />s:\council\derrick.doc <br /> <br /> <br />
