Memo to the Planning Commission/CU 96-19
February 25, 1997
Page 3

Other Issues

The change in residency really has no affect on the landscaping
requirements, utilities or grading. However, it is worth mentioning that one
of the reasons for changing the entrance into the project from Highland Road
to Jackson was a safety concern for residents exiting onto Highland Road.
There is a slight vertical curve on Highland Road as it extends west of
Jackson. This curve contributes to a visibility concern for eastbound traffic
on Highland Road.

Recommendation

It is recommended the Planning Commission consider amending the planned
unit development agreement for Derrick Investment to eliminate the
residency requirements from the original proposal of 55 years and older.
Staff does not believe removing the residency requirement will have an
impact on the "physical planning" of the townhouse project. The real issue is
whether the Planning Commission and the City Council approved the
rezoning and PUD based on the 55 years and older concept. If the
Commission recommends approving the amendment to the planned unit
development agreement, staff would recommend adding a condition which
reads as follows:

The plans be modified accordingly to provide adequate off street parking
at a ratio of .5 parking stalls per unit. These additional parking stalls can
be included as part of extended driveways, on-street parking on those
streets 30 feet and wider, and at the end of driveways where additional
parking stalls can be created.

\\elkriver\sys\shrdoc\planning\pc\cu96-19.doc
